1. Definitions

In these Terms and Conditions:

• "Agreement" means these Terms and Conditions together with the Rental Contract
• "Drivara," "we," "us," "our" refers to Drivara operating at 1 Harbourfront Walk, #02-48, Singapore 098585
• "Renter," "you," "your" refers to the individual or entity renting a vehicle from us
• "Vehicle" means the motor vehicle identified in the Rental Contract
• "Rental Period" means the period from vehicle handover to return as specified in the Rental Contract
• "Rental Contract" means the specific agreement for each vehicle rental

2. Acceptance of Terms

By renting a vehicle from Drivara, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not proceed with the rental.

You represent that you are at least 21 years of age and possess the legal capacity to enter into this binding agreement under Singapore law.

3. Rental Eligibility

3.1 Age Requirements

• Minimum age: 21 years for Metropolitan Sedan Charter
• Minimum age: 25 years for Grand Tourer Weekender and Heritage Marque Portfolio
• Maximum age: 75 years (exceptions considered on case-by-case basis)

3.2 Driving Licence Requirements

• Valid Singapore driving licence held for minimum 2 years, or
• Valid international driving permit with passport, held for minimum 2 years
• Licence must be valid throughout the entire Rental Period
• Class 3 or equivalent licence required for all vehicles

3.3 Additional Requirements

• Valid credit card in renter's name for security deposit
• Proof of identity (NRIC or passport)
• Clean driving record (no major violations in past 3 years)
• Completion of vehicle orientation before departure

4. Rental Rates and Payment

4.1 Rental Charges

Rental rates include:

• Vehicle rental for specified period
• Comprehensive insurance coverage
• Daily mileage allowance as stated in Rental Contract
• Complimentary delivery and collection within central Singapore
• 24/7 support line during Rental Period

4.2 Additional Charges

You will be charged for:

• Mileage exceeding daily allowance at SGD 0.80 per km (sedans), SGD 1.20 per km (grand tourers), SGD 1.50 per km (heritage marques)
• Late return: 20% of daily rate per hour (first hour), full daily rate after 2 hours
• Fuel replacement if vehicle not returned with full tank
• Traffic violations, parking fines, ERP charges incurred during rental
• Toll charges for cross-border travel
• Damage to vehicle exceeding insurance coverage
• Interior cleaning for excessive soiling: SGD 150-500

4.3 Security Deposit

A refundable security deposit is required:

• Metropolitan Sedan: SGD 1,500
• Grand Tourer: SGD 3,000
• Heritage Marque: SGD 5,000

The deposit will be released within 7 business days after vehicle return and final inspection, less any deductions for damages, violations, or outstanding charges.

4.4 Payment Terms

• Full payment due at time of booking confirmation
• Accepted payment methods: Credit cards (Visa, Mastercard, American Express)
• All prices quoted in Singapore Dollars (SGD)
• 7% GST applicable to all charges

5. Renter Responsibilities

5.1 Vehicle Operation

You agree to:

• Operate the vehicle in accordance with Singapore traffic laws
• Use the vehicle only for lawful purposes
• Maintain the vehicle in good condition during the Rental Period
• Check oil, water, and tire pressure regularly
• Refuel with correct fuel grade as specified
• Park only in authorized locations
• Not smoke or vape inside the vehicle
• Not transport pets without prior written approval

5.2 Prohibited Uses

You must NOT:

• Allow anyone other than authorized drivers to operate the vehicle
• Use the vehicle for racing, testing, or any competition
• Use the vehicle while under the influence of alcohol or drugs
• Use the vehicle to transport illegal substances or contraband
• Use the vehicle for hire or commercial transport without authorization
• Modify or alter the vehicle in any way
• Remove the vehicle from Singapore without cross-border documentation
• Exceed posted speed limits or drive recklessly
• Overload the vehicle beyond manufacturer specifications

5.3 Accident and Damage Reporting

• Report all accidents to us within 4 hours, regardless of severity
• Obtain police report for all accidents involving third parties
• Do not admit liability or make statements at accident scene
• Provide full cooperation with insurance claims process
• Document damage with photos and obtain contact details from other parties

6. Insurance Coverage

6.1 Included Coverage

• Comprehensive insurance meeting Singapore regulatory requirements
• Third-party liability coverage
• Theft protection
• Fire and natural disaster coverage

6.2 Excess and Deductibles

• Metropolitan Sedan: SGD 3,000 excess
• Grand Tourer: SGD 5,000 excess
• Heritage Marque: SGD 8,000 excess

6.3 Coverage Exclusions

Insurance does NOT cover:

• Damage caused by prohibited uses listed in Section 5.2
• Damage to tires, wheels, or undercarriage from improper use
• Interior damage or cleaning beyond normal wear
• Loss of keys or remote controls
• Personal belongings left in vehicle
• Damage occurring outside Singapore without proper documentation

7. Vehicle Delivery and Return

7.1 Delivery

• Complimentary delivery within central Singapore (District 1-10)
• Delivery charges may apply for locations outside central areas
• Vehicle orientation provided at handover
• Pre-rental inspection conducted jointly with renter
• Any existing damage documented on condition report

7.2 Return

• Vehicle must be returned at agreed time and location
• Vehicle must be returned with full fuel tank
• Post-rental inspection conducted at return
• Late returns subject to charges as specified in Section 4.2
• Early returns do not qualify for refunds

8. Cancellation and Refunds

8.1 Cancellation by Renter

• More than 7 days before rental: Full refund less 5% administrative fee
• 3-7 days before rental: 50% refund
• Less than 3 days before rental: No refund
• No-show: No refund

8.2 Cancellation by Drivara

We reserve the right to cancel reservations in cases of:

• Vehicle unavailability due to unforeseen circumstances
• Failure to provide required documentation
• Discovery of false information in rental application

In such cases, we will provide full refund of payments made or offer alternative vehicle of comparable class.

9. Limitation of Liability

To the maximum extent permitted by Singapore law:

• Our liability is limited to direct damages not exceeding the total rental charges paid
• We are not liable for indirect, consequential, or incidental damages
• We are not liable for personal injury except where caused by our negligence
• We are not liable for delays, breakdowns, or mechanical failures
• We are not responsible for loss or damage to personal property

This limitation does not affect any statutory rights you may have as a consumer under Singapore law.

10. Indemnification

You agree to indemnify and hold harmless Drivara, its officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the vehicle, violation of these Terms and Conditions, or breach of any law or regulation during the Rental Period.

11. Termination

We may terminate the rental and repossess the vehicle immediately without refund if:

• You violate any term of this Agreement
• You provide false information in your rental application
• The vehicle is used for prohibited purposes
• You fail to make required payments
• The vehicle is abandoned or improperly parked
• You are arrested or involved in serious traffic violations

You remain liable for all charges and damages up to termination date.

12. Dispute Resolution

This Agreement is governed by the laws of Singapore. Any disputes arising from this Agreement shall be resolved as follows:

1. Informal Resolution: We encourage you to contact us first at [email protected] to resolve disputes amicably
2. Mediation: If informal resolution fails, disputes may be referred to Singapore Mediation Centre
3. Arbitration: Unresolved disputes shall be subject to arbitration under Singapore International Arbitration Centre rules
4. Jurisdiction: Courts of Singapore shall have exclusive jurisdiction over any disputes

13. General Provisions

13.1 Entire Agreement

These Terms and Conditions, together with the Rental Contract, constitute the entire agreement between parties and supersede all prior agreements or understandings.

13.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions shall continue in full force.

13.3 Waiver

Failure to enforce any provision does not constitute waiver of that provision or any other provision.

13.4 Assignment

You may not assign or transfer your rights under this Agreement. We may assign our rights to any successor or affiliate.

13.5 Notices

All notices must be in writing and sent to addresses specified in Section 15.

14. Changes to Terms

We may update these Terms and Conditions periodically. Changes will be communicated through:

• Email notification to registered renters
• Website posting with 30 days' notice
• Updated "Last Updated" date at top of this document

Continued use of our services after changes become effective constitutes acceptance of updated terms.
